Document #31 (Motion Adopted by All Defense Counsel) shows one of the key Nazi defense strategies: the concept of ex post facto, or a criminal statute that punishes actions retroactively, thereby criminalizing conduct that was legal when originally performed. Of course, the Nuremberg prosecution’s claim was that the entire Nazi enterprise was a criminal conspiracy; so, ex post facto did not apply.
In light of #31, comment upon Gring’s testimony (#28) and Robert Jackson’s cross examination (#29). Expost Facto , show the concept and discuss why this tactic would fail.
