1. The first section I chose was Section 300.102 Limitation –which is the exception to FAPE for certain ages. In reading this section I learned there are exceptions where FAPE does not apply.  I found this section confusing, and have some questions. My question is, this section states that a child aged 4 would not receive FAPE. Does that mean children who are age 4 and enter Pre-K do not receive free appropriate public education?

2. The second section I chose Section 300.133 Expenditures, which are Services provided to parentally-placed private school children with disabilities in accordance with the provisions in the IDEA and its implementing regulations. I did not know how schools were given their funds. By reading this section I learned that it is based off how many parentally-placed private school children with disabilities there are in the district. The count for school children is taken on any date between October 1 and December 1, inclusive, of each year.

I asked my Special Education director to share with me the tool the district uses to figure out the proportionate share and this is what she sent. It seems to be a pretty straight forward sheet to figure out total amount.

Continuing with Section 300.133 this is monies in which the LEA must spend on special education programs and related services. It surprised me that if the money is not spent it does not need to be returned, but instead the LEA must obligate the remaining funds for special education and related services.
