The purpose of classifying terms into conditions and warranties is to identify if their breach gives rise to a right to damages or also the option to terminate the contract. It is therefore unfair for the law to impose this dichotomy at the time the contract is formed as it prevents the remedies for a breach of contract from rightly reflecting the actual consequences of that breach.
