Back in 2011, New Balance introduced a new line of shoes it claimed had features that “[used] hidden balance board technology that encourages muscle activation in the glutes, quads, hamstrings and calves, which in turn burns calories.”

Multiple studies cited in the resulting class-action lawsuit indicated that the shoes didn’t provide any additional health benefits compared to walking shoes and might actually lead to injury.

Please write a memo to discuss the possible result of a lawsuit based on the above facts. You need to follow the format of a memo. In the IRAC part, you need to pay attention to the following points.

  1. You need to identify a legal issue based on consumer law.
  2. You need to base your essay on and only on the legal knowledge you learnt from the textbook.
  3. You need to write from the perspective of a purchaser of the New Balance shoe as advertised in 2011.

  • What is the legal issue if you purchased the shoe and find it does not benefit health?
