In this Discussion Question (DQ) assignment: Read the following Chapter 7 information and fact pattern(s); then answer the questions that follow.

EMBEZZLEMENT / or LARCENY-THEFT (e. g., grand larceny, petit larceny, larceny by trick): see textbook pp. 159-169; note the listed elements of these crimes.

Fact Pattern(s):

  1. Xavier, a friend of Yancey, requests, and is loaned Yancey’s car for a personal errand. Xavier subsequently decides to appropriate the vehicle. Xavier had formed the intent to steal Yancey’s vehicle when he originally asked for to use it.

DQ: (a) Based on the facts and, (b) based on the elements of embezzlement and/or larceny, can Xavier be convicted of embezzlement or larceny-theft of the vehicle? Why or Why Not? Explain

  1. Xavier, is the owner of Midtown Jewelers. Xavier gives Yancey, a minor employee, a watch to deliver to Zelda, owner of Zelda’s Jewelers. Yancey decides to abscond with the watch before reaching Zelda’s.

DQ: (a) Based on the facts and, (b) based on the elements of embezzlement and/or larceny, can Xavier be convicted of embezzlement or larceny-theft of the watch? Why or Why Not? Explain
